1. Introduction
These Terms & Conditions govern the tutoring services provided by BrightUp Learning ("BrightUp Learning", "we", "our", or "us"). By booking lessons with us, you agree to these Terms & Conditions.
If the student is under the age of 18, these Terms & Conditions must be accepted by a parent or legal guardian.
2. Our Services
BrightUp Learning provides online one-to-one tutoring for primary school students, including Years 2–6, SATs preparation, and other educational support.
Tutoring may include the use of technology to support learning, such as automatically generated practice questions, progress tracking and educational tools.
3. Your Right to Cancel (14-Day Cooling-Off Period)
Under the Consumer Contracts Regulations 2013, you generally have the legal right to cancel a booking within 14 days of making it, without giving a reason, and receive a full refund. If a lesson takes place within this 14-day window with your express request and agreement, this right may be waived for that specific lesson once delivered.
This right is in addition to, and does not affect, the cancellation and refund terms set out in Section 6.
4. Bookings & Payments
All lesson payments are processed securely through Stripe.
Lessons are confirmed only after payment has been successfully received.
Prices displayed on our website are subject to change, but any confirmed booking will remain at the agreed price.
5. Attendance
Students should join lessons on time using the link or platform provided.
Parents or guardians are responsible for ensuring the student has:
- •A stable internet connection.
- •A suitable device.
- •A quiet learning environment.
6. Cancellations & Refunds (Parent/Guardian-Initiated)
If a parent or guardian wishes to cancel a booked lesson, BrightUp Learning may provide a refund of up to 75% of the lesson fee, depending on the notice provided and the circumstances of the cancellation.
Refund requests are assessed individually.
7. Tutor Availability (BrightUp-Initiated Cancellation)
If BrightUp Learning is unable to deliver a lesson due to circumstances within our control (for example, a tutor experiencing technical difficulties or internet failure), this is different from a parent/guardian-initiated cancellation (Section 6): the fee was paid in exchange for a service we did not deliver, through no fault of the parent/guardian. We will offer:
- •A rescheduled lesson at no extra cost; or
- •A full (100%) refund of the lesson fee.
8. Student Behaviour
Students are expected to behave respectfully during all tutoring sessions.
BrightUp Learning reserves the right to end a lesson if behaviour is abusive, threatening or repeatedly disruptive.
9. Safeguarding
BrightUp Learning takes the safety and wellbeing of every student seriously. Please refer to our Safeguarding Policy for full details of our approach.
10. Educational Outcomes
BrightUp Learning aims to help every student improve their confidence and academic performance.
However, we cannot guarantee:
- •Specific grades
- •SATs scores
- •11+ results
- •School admissions
- •Examination outcomes
Success depends on many factors, including attendance, effort and independent practice.
11. Intellectual Property
All lesson materials, worksheets, questions, resources and website content remain the property of BrightUp Learning unless stated otherwise.
They may not be copied, shared or resold without written permission.
12. Privacy
We collect and process personal information in accordance with our Privacy Policy.
Parents or guardians are responsible for ensuring that the information provided is accurate.
13. Limitation of Liability
BrightUp Learning will provide its services with reasonable care and skill.
To the fullest extent permitted by law, BrightUp Learning shall not be liable for indirect or consequential losses arising from the use of our tutoring services.
Nothing in these Terms excludes liability where it cannot legally be excluded under the laws of England and Wales.
14. Changes to These Terms
We may update these Terms & Conditions from time to time.
The latest version will always be available on our website.
15. Governing Law
These Terms & Conditions are governed by the laws of England and Wales.
Any disputes shall be subject to the jurisdiction of the courts of England and Wales.
